Acceptable Use Policy

GloboTech Communications Acceptable Use Policy ("AUP") is provided to give our customers and users a clear understanding of what GloboTech Communications expects from them while using the service. All users of GloboTech Communications services: those who access some of our Services but do not have accounts, as well as those who pay a service fee to subscribe to the Services, must comply with this AUP and our TOS (Terms of Service).


If a GloboTech Communications account is used to violate the Acceptable Use Policy or our TOS, we reserve the right to terminate your service without notice. We prefer to advise customers of inappropriate behavior and any necessary corrective action, however, flagrant violations of the Acceptable Use Policy will result in immediate termination of service. Our failure to enforce this policy, for whatever reason, shall not be construed as a waiver of our right to do so at any time.


1. General

1.1. GloboTech Communications services may not be used for illegal purposes, or in support of illegal activities. GloboTech Communications reserves the right to cooperate with legal authorities in the investigation of any suspected crime or civil wrongdoing.

1.2. GloboTech Communications services may not be used to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.

1.3. GloboTech Communications services may not be used to transmit any material (by e-mail, uploading, posting or otherwise) to harasses another.

1.4. GloboTech Communications services may not be used to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scams.

1.5. GloboTech Communications users may not add, remove or modify identifying network header information in an attempt to deceive or mislead.

1.6. GloboTech Communications services may not be used to transmit any unsolicited commercial or unsolicited bulk e-mail.

1.7. GloboTech Communications services may not be used to impede another person's use of electronic mail services or news.

1.8. GloboTech Communications users may not forge any message header, in part or whole, of any electronic transmission, originating or passing through the GloboTech Communications network.

1.9. GloboTech Communications services may not be used to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of GloboTech Communications or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data. The offending account is subject to immediate termination.

1.10. GloboTech Communications users may not transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party.

1.11. GloboTech Communications services cannot be used to collect, or attempt to collect, personal information about third parties without their knowledge or consent.

1.12. GloboTech Communications services may not be used for any activity, which affects the ability of other people or systems to use GloboTech Communications Services or the Internet. This includes "denial of service" (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the user's responsibility to ensure that their network is configured in a secure manner.

1.13. GloboTech Communications users may not intentionally distribute software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems.

1.14. GloboTech Communications subscribers will be held responsible and accountable for any activity by third parties, using their account that violates guidelines created within the Acceptable Use Policy.

1.15. GloboTech Communications does not allow IRC related services without the proprer filtering services.

1.16. GloboTech Communications allows adult content as long as the material is legal, or that you own it or is part of the public domain.

1.17. GloboTech Communications users may not utilize more then their allocated system resources..

2. Linux Shell Account Policy

In accordance to Section 1, our Linux Shell Account user must, also, comply with the following policy.

2.1. The storage space provided by GloboTech Communications shall not be used for storing pirate media in any shape or form.

2.2. It is prohibited to use GloboTech Communications resources to promote or advertise.

2.3. Users who attempt to penetrate security measures are logged and shall be prosecuted to the fullest extent of the law.

2.4. It is prohibited for a GloboTech Communication user to excessively consume resources, including CPU time, memory, disk space and bandwidth. You may not use resource-intensive programs, which negatively impact other customers.

2.5. GloboTech Communications users agree to follow the rules indicated by each IRC server or network.

2.6. GloboTech Communications users shall respect the number of background processes indicated on his/her package. A customer found to be running more than the allowed background processes will get all of his/her processes killed without notice.

2.7. GloboTech Communications does not allow the use of energy emechs, xdcc bots, or any war scripts. All scripts or programs must be approved by GloboTech Communications.

2.8. GloboTech Communications does not allow multiple users on a bouncer (psybnc, bnc, ezbounce, etc).

2.9. It is prohibited for a GloboTech Communications user to participate in takeovers with or without their GloboTech Communications service.

2.10. GloboTech Communications users will take precautions in order Denial of Service Attacks incident.

2.11. GloboTech Communications users can only use the virtual-hosts indicated on our public list.

3. Web Hosting and Web Hosting reseller Policy

In accordance to Section 1, our Web Hosting users and Web Hosting reseller users must, also, comply with the following policy.

3.1. The storage space provided by GloboTech Communications shall not be used for storing pirate media in any shape or form.

3.2. It is prohibited for users to transmit unsolicited e-mails with their GloboTech Communications account.

3.3. It is prohibited for users to intentionally distributing software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited.

3.4. It is prohibited for a GloboTech Communication user to excessively consume resources, including CPU time and memory. You may not use resource-intensive programs, which negatively impact other customers.

4. Virtual Servers Policy

In accordance to Section 1, our Virtual Server users must, also, comply with the following policy.

4.1. GloboTech Communications does not tolerate unsolicited e-mails.

4.2. GloboTech has the right to investigate any virtual server found to be using excessive machine resources.

4.3. It is prohibited for users to intentionally distributing software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited.

4.4. The storage space provided by GloboTech Communications shall not be used for storing pirate media in any shape or form.

4.5. GloboTech Communications users agree to follow the rules indicated by each IRC server or network.

4.6. GloboTech will not be responsible for the security of the Virtual Server. It is up to the customer, to take the necessary steps to secure his virtual server.

5. How to report a violation
GloboTech Communications requests that anyone who believes that there is a violation of this AUP direct the information to the Abuse Department at abuse@gtcomm.net.

If available, please provide the following information:

  • The IP address used to commit the alleged violation
  • The date and time of the alleged violation, including the time zones or offset from GMT
  • Evidence of the alleged violation
  • E-mail with full header information provides all of the above, as do system log files.
  • Other situations will require different methods of providing the above information.
GloboTech Communications may take any one or more of the following actions in response to complaints:

  • Issue written or verbal warnings
  • Suspend the Member's newsgroup posting privileges
  • Suspend the Member's account
  • Terminate the Member's account
  • Bill the Member for administrative costs and/or reactivation charges
  • Bring legal action to enjoin violations and/or to collect damages, if any, caused by violations


REVISIONS TO THIS ACCEPTABLE USE POLICY

GloboTech Communications reserves the right to revise, amend, or modify this AUP, our TOS (Terms of Service) and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with our TOS (Terms of Service).
